SCOPE OF THIS POLICY

This Website Privacy Policy (“Policy”) describes how Networking Technology, Inc. dba RXNT (“RXNT,” “We,” “Us,” or “Our”) collects, uses, and discloses information about you when you visit and interact with our websites, including www.rxnt.com and www.rxnotify.com (collectively, our “Websites”). It also outlines the choices available to you regarding our use of your personal information and how you can access and update it.

This Policy pertains solely to the use of our Websites (including when you access our Websites via your mobile device). It does not cover information we may collect, receive, or share from our cloud-based desktop and mobile applications or other software products, including RXNT Electronic Health Records (EHR), Practice Management (Billing and Scheduling), Electronic Prescribing, and Patient Portal, or related functionality and services (collectively, our “Products”). For more information about our privacy practices regarding information collected, received, or processed through our Products, please see our Client Services Privacy Policy.

This Policy does not cover the privacy policy of third parties. Our Websites may include links to websites and/or applications operated and maintained by third parties. We encourage you to review the privacy policies of those third parties because we have no control over the privacy policies of websites or applications owned by those third parties, and we cannot guarantee that such third parties will adhere to the same privacy practices that we do.

By using our Websites, you agree to be bound by the terms of this Policy and the Terms of Use of our Websites. If you do not agree to be bound by them, you are not authorized to access any of our Websites.

INFORMATION WE COLLECT

The types of information we collect about you depend on how you interact with our Websites. Some of the information collected by RXNT is personal information. In general, the term “Personal Information” is information that identifies you, describes you, relates to you, or can be associated with you. RXNT sometimes combines non-personal information with other information in a way that makes the combined information Personal Information. RXNT treats this combined information as if it were all Personal Information. RXNT does not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual. The following categories and types of Personal Information may be collected by us when you visit and use our Websites:

Identifiers and Contact Information
When you use some features on our Websites, such as requesting a demonstration, signing up for our In The Cloud Newsletter, engaging with our Sales Bot, or Live Chat, we collect basic identifying information about you including your full name, email address, company name, mobile phone number, state of residence, and other similar identifiers. 

Commercial and Professional Information
When you request product information through our Websites, such as success stories, blogs, or pricing, we may collect information related to your organization including your organization’s name, how many providers are in your organization, the organization phone number, the state your organization is located, your organization’s product and service interests, and your preferences in receiving marketing materials and communications from us.

User Content
When you communicate with us, we collect the information you provide, including emails, chat messages, product reviews, testimonials, messages, usernames and passwords, feedback, survey responses, and other content. As a patient, communications received from RXNT may relate to administrative aspects of your care, e.g., appointment requests, reminders, prescriptions, savings, cancellations, and other notifications.

Transaction and Financial Information
When you purchase products or services from us, we collect details regarding your purchases. We collect payment details, either directly collected by us or indirectly collected through a third-party payment service provider for Website-related transactions.

Internet or Other Network Activity
When you visit our Websites, RXNT may automatically collect and record information from your browser, including your internet protocol (IP) address, operating system, browser type, access dates and times, search and browsing history, and information related to your interactions with our Websites, emails, texts, and advertisements. 

Device Information and Tracking Technology
When you use our Websites, we collect data about your device and how you interact with our Websites. This data may include your IP address, cookies, beacons, pixel tags, browser type, device type, device identifiers, browsing or search history, operating systems, and language settings.

Usage and Performance Information
RXNT collects data related to the use of our Websites. This data may include your interactions with our Websites, error reports, and general performance data. This data helps us to diagnose problems with our Websites and to improve various features and solutions for your future use.

Geolocation Data
RXNT may collect information, including your IP address, that allows us to determine your general location (e.g., based on IP address). You may also manually provide location information when using the demonstration request on our Websites, or enable your mobile device to send us precise location information. Following any applicable legal requirements, to the extent precise location-based information is considered sensitive information under applicable law, we will ask for your permission before we collect or use precise location information (e.g., GPS coordinates).

Employment and Career Information
If you apply for employment at RXNT, we collect information from you in connection with your application and interview(s) for employment. This information includes professional information such as education, employment history, and other information you provide as a component of your job application. This may include your LinkedIn or other social media profiles. If RXNT retains you as an employee, we will collect your Social Security number or taxpayer ID.

Audio and Visual Information
RXNT may record your voice or likeness, such as when you attend an online product demonstration, or when we record customer service calls for quality assurance. If you are an RXNT employee or contractor, we may collect audio and visual recordings of webinar calls or client calls.

Inferences
RXNT may also use the information identified in this section to draw inferences.

HOW WE COLLECT INFORMATION

User-Provided Information
RXNT obtains Personal Information when you provide it to us when you visit our Websites. Personal information is collected when you request product information, request a demonstration, contact us, apply for a job, sign up to receive emails or text messages, or sign up to receive our quarterly newsletter or other marketing communications. If you are an employee or contractor of a service provider, business partner, or third party we work with, we may collect information when you contact and communicate with us. This information may include basic identifiers such as your name, work email address, and other professional information like your title and company.

Cookies
To improve the use and functionality of our Products, various cookies (outlined below) are used to recognize your preferences and temporarily store session information on your browser. A cookie is a small text file that often includes an anonymous unique identifier, which is placed on your device’s hard drive by a webpage server. Cookies contain information that can later be read by a web server in the domain that issued the cookie. We link the information we store in cookies to Personal Information you submit while on our Websites.

We use third-party cookies to track and improve the experience of visitors on our Websites. If you do not want the Websites to deploy cookies in your browser, you can set your browser to reject cookies or to notify you when a website tries to put a cookie in your browser software. You can also manually clear the cookies within your respective browser (see your browser for help). If you configure your browser to reject certain cookies, the opt-out may not function properly. If you change browsers or devices, or delete cookies, you may need to opt out again.

  • Strictly Necessary Cookies. These cookies are necessary for our Websites to function and do not store any personally identifiable information. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences or submitting forms. If you reject strictly necessary cookies, you may still use our Websites, but your ability to use some areas of our Websites may be limited.
  • Performance Cookies. These cookies enable us to measure and improve the performance of our Websites by telling us how visitors interact with our Websites, including which pages they visit. All information collected through performance cookies is aggregated and anonymous. If you reject performance cookies, we will not know when you have visited our website and will not be able to monitor the performance of our Websites.
  • Functional Cookies. These cookies enable our Websites to provide enhanced functionality and personalization. They may be set by us or by third-party providers whose services we have added to our pages. If you reject these cookies, some or all of these services may not function properly.
  • Targeting Cookies. These cookies may be set through our Websites by our advertising partners. They store information that may uniquely identify your browser and device to build a profile of your interests and show you relevant advertisements on other websites. If you reject targeting cookies, you will no longer receive personalized advertisements.

Web Beacons / GIFs

RXNT uses software technology called clear GIFs or web beacons to help us better manage content on our Websites by informing us what content is effective. These technologies are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear GIFs are embedded invisibly on web pages and are about the size of the period at the end of this sentence. In some cases, we tie information gathered by clear GIFs to our customers’ Personal Information; an example would be tracking emails that have been opened by recipients, which allows us to measure the effectiveness of our communications and marketing campaigns.

Third-Party Tracking

The use of cookies by any tracking utility company is not covered by our privacy policy. We do not have access to or control over these cookies. A tracking utility company may use session ID cookies and/or persistent cookies.

We use local storage, such as HTML5, to store content information and preferences. Third parties with whom we partner to provide certain features on our website or to display advertising based upon your web browsing activity also use HTML5 to collect and store information. Various browsers may offer their management tools for removing HTML5.

Behavioral Targeting / Re-Targeting

We partner with a third-party ad network to either display advertising on our Websites or to manage our advertising on other sites. Our ad network partner uses cookies and web beacons to collect information about your activities on our Websites and other websites to provide you with targeted advertising based on your interests. If you do not wish to have this information used to serve you targeted ads, you may opt out of interest-based advertising across browsers and devices that participate in the Digital Advertising Alliance or Network Advertising Initiative by visiting their websites www.aboutads.info/choices and www.networkadvertising.org, respectively. You may also opt out of interest-based advertising through the settings on your device or within a mobile app, but your opt-out preferences may apply only to the browser or device you are using when you opt out. Please note this does not opt you out of advertising. You will continue to receive generic ads.

Social Media Platforms
If you interact with RXNT on social media features or use features, such as plugins, widgets, single-sign-on, or other tools made available by social media platforms in connection with our Websites, we collect information that you share with us or that the social media platforms share with us. These platforms include, but are not limited to Facebook, X, LinkedIn, and Google. Please review the privacy policies and settings of the social media platforms and networks that you use for more information about their privacy practices.

Additional Sources
We may also receive information about you from third-party partners or publicly available sources, where permitted by law, such as data analytics providers, fraud prevention service providers, vendors that provide services on our behalf, marketing and advertising service providers, or publicly available sources. We may combine this information with information collected directly from you.


HOW
WE USE INFORMATION COLLECTED

RXNT uses the information we collect for the following purposes:

  • Communication. If you contact us through our Websites, we will use your Personal Information to respond to you, communicate with you in the future, and share updates regarding our products or other relevant information, including relevant offers from third-party partners.
  • Providing Services. If you request a product demo and sign up for our services, we may use the information you provided in your request to service and maintain your account, provide customer support, and communicate with you about our products and services.
  • Website Performance and Personalization.  We use Personal Information to save user preferences, authenticate users, debug, and improve the performance of our Websites. Additionally, we use Personal Information to understand how you interact with our Websites, advertisements, and communications with you, to determine which of our products or services are most popular, and to improve our Websites, products, services, and marketing campaigns.
  • Marketing and Advertising. We use Personal Information to market, promote, and advertise to you. This includes sending communications via email, text message, or postal mail to inform you about our services, products, new product launches, and referrals, as well as displaying advertisements for our products and services on social media and other websites.

  • Legal & Security. We may provide access to your Personal Information to respond to law enforcement requests, court orders, governmental regulations, or as otherwise required under applicable law; to take appropriate action regarding any use of our Websites that may violate any law or regulation; to protect the health, safety, security, property, and interests or rights of us or others; and to investigate or respond to or resolve problems or inquiries or defend our interests.

HOW
WE SHARE INFORMATION

With regard to Personal Information, RXNT appreciates its sensitivity and the need to limit its disclosure. Accordingly, we limit our sharing of your Personal Information as follows:

  • As Required By Law. We may provide access to your Personal Information when we are legally required to do so, such as to comply with a subpoena, search warrant, court order, judicial proceeding, or similar legal process, or if your conduct violates our Website Terms of Use.
  • Protection. When RXNT believes in good faith that disclosure is necessary to protect the Products and anything related to them, protect your safety or the safety of others, protect our rights and the rights of third parties, investigate fraud, or respond to a governmental agency or court order.
  • Service Providers. When RXNT provides such information to trusted service providers who work on our behalf, they do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules outlined in this Policy and applicable law. Such information is provided to them subject to the terms of this Policy.
  • Business Partners. When RXNT obtains your consent, we share your name and email with partners we may work with. You may opt out of this sharing by contacting RXNT using the contact information provided in this Policy.
  • Control Transfers. If RXNT is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Websites of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding such information.
  • Third Parties. Information may be collected and shared between RXNT and third parties. For example, RXNT engages third parties to help us deliver advertisements, and these third parties may collect your information over time across our Websites (and third-party websites) in order to associate different devices you use and further gain insights into the services and products that may interest you.

WHERE YOUR PERSONAL INFORMATION IS STORED AND PROCESSED

RXNT is based in the United States and uses service providers that may be located outside of the United States. If you submit Personal Information to us, your Personal Information may be processed in a foreign country where privacy laws may be less strict than the United States laws. By submitting your Personal Information to us, you agree to the transfer, storage, and processing of your Personal Information in a country other than your country of residence.


PROTECTION OF YOUR INFORMATION

Your Personal Information is maintained on RXNT’s and our service providers’ servers, and may be accessible by authorized employees, representatives, and agents as necessary for the purposes described in this Policy.

RXNT utilizes and periodically evaluates the effectiveness of technical, physical, and administrative measures to prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of your information. These measures include encryption, firewalls, system alerts, and the use of industry-standard encryption technology. We also house such information in secure facilities that restrict physical and network access.

YOUR RIGHTS

Depending on your state of residence within the U.S., you may have the right to request access to and receive details about or a copy of the Personal Information we maintain or have processed about you, to update and correct inaccurate information, or to delete your Personal Information. You may also have the right to withdraw your consent to our processing of your Personal Information. These rights may be limited in some circumstances by applicable law. This section describes your rights and how to exercise them.

  • Right to Access Your Personal Information: You have the right to request that we disclose certain information to you regarding our collection and use of your Personal Information over the past twelve months. Upon receiving your request and confirming your identity, we will disclose to you:
    • The categories of Personal Information we collected and the source of such collection. 
    • RXNT’s business or commercial purpose for collecting or selling that Personal Information. 
    • If we sold or disclosed your Personal Information for a business purpose, we will provide two lists disclosing: (1) sales, identifying the Personal Information categories that each category of recipient purchased, and (2) disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained. 
    • The categories of third parties with whom we share that Personal Information. 
    • The specific pieces of Personal Information we collected about you (a.k.a., data portability request).

We will retain your information for as long as your account is active or as needed to provide you services, comply with our legal obligations, resolve disputes, and enforce our agreements.

  • Right to Correct/Update Your Personal Information: You may update your information by contacting us using the RXNT Help Center or calling us at 410-871-8693.
  • Right to Request Deletion of Your Personal Information: You have the right to request that RXNT delete any of your Personal Information that we have collected and retained from you, subject to certain exceptions. Once you submit a deletion request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service providers to:
    • Detect security incidents and protect against malicious, fraudulent, or illegal activity, or prosecute those responsible for such activities. 
    • Debug to identify and repair errors that impair our existing intended functionality. 
    • Complete the transaction for which your information was collected, provide goods or services you have requested, or perform a contract you have entered into with RXNT. 
    • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.). 
    • Enable solely internal uses that are reasonably aligned with the expectations of the consumer based on your relationship with us. 
    • Comply with a legal obligation. 
    • Exercise free speech, ensure the right of another consumer to exercise their right of free speech, or exercise another right provided by law.
    • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws. 
    • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or de-identify Personal Information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

  • Right to Opt-Out of Cookies and Sale/Sharing Personal Information: RXNT’s use of online tracking technologies may be considered a sale or sharing under applicable law. You may opt out of being tracked by these third parties by clicking the “Opt Out request button on our Websites. Depending on your state of residence, you may also opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal). To download and use a browser supporting the GPC browser signal, click here: https://globalprivacycontrol.org/orgs. If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.
  • Right to Limit Sensitive Personal Information: Your state of residency may provide you the right to limit the use of sensitive Personal Information. RXNT only collects sensitive Personal Information provided to us by you, such as your social security number, financial account information, and as otherwise defined by applicable law. Some purposes for the collection and processing of sensitive information include verifying your identity, such as in the job application process. RXNT only uses sensitive information for the use disclosed to you at the time you provide it to us. RXNT does not use sensitive information to infer characteristics about you. RXNT does not offer the right to limit the use of sensitive Personal Information.
  • Right to Non-Discrimination: You have the right to be free from discrimination for exercising your privacy rights.
  • Right to Appeal: Residents of certain states may have the right to appeal our decision regarding your request.

Exercising Your Rights. If you need assistance updating your Personal Information, or you would like further information regarding your legal rights under applicable law, or would like to exercise any of them, please contact us via email addressed to [email protected] or call us at 800-943-7968 and ask for legal.

If you are a California resident, under the CCPA, you may submit a Request to Know up to twice within a twelve-month period. If you are a Connecticut resident, you may submit a Request to Know once within a twelve-month period. Your request must provide us with sufficient information that allows us to reasonably verify your identity or an authorized representative and describe your request with sufficient detail, allowing us to properly understand and respond to it. We are unable to respond to a request or provide Personal Information if we cannot verify your identity or authority to make the request and confirm that the Personal Information relates to you.

Identity Verification. For security purposes, we may request additional information from you to verify your identity when you request to exercise your rights. Once you submit a request to exercise your rights, we will verify your identity. Upon successfully verifying your identity, we will provide you with your requested information in a secure, password-protected format if necessary. If we are unable to verify your identity, we will notify you.

Promotional Emails. Click the “unsubscribe” link at the bottom of any promotional emails you receive from RXNT to stop receiving them. If you have any questions about your choices or if you need any assistance with opting out, please contact us by sending an email to [email protected]. You can also write to us at the address in the How to Contact Us section below in the menu at the bottom of this web page.

Text Messages. To opt out of receiving text messages from us, you can reply “STOP” to any text message you receive from us. If you are a patient of a healthcare provider who uses our services, please contact your healthcare provider to update your communication preferences. 

Authorizing Agent. Depending on your state of residence within the United States, you may designate an authorized agent to submit a request on your behalf to exercise your privacy rights described herein. To authorize an agent to do so, you must: (1) provide to such agent your signed permission to submit such request; and (2) verify your own identity directly with us. If the agent does not provide us with adequate proof that they have been authorized by you to act on your behalf, we may deny the agent’s request.


CHILDREN’S ONLINE PRIVACY

Our Websites are not intended for minors under the age of eighteen (18). RXNT does not wish to obtain any information from or about such minors through the Websites and does not knowingly collect Personal Information through our Websites directly from children under the age of 18 without parental consent. If we become aware that a child under the age of 18 has provided us with Personal Information through our Websites, we will delete the information from our records. If you discover that your child has provided us with Personal Information without your consent, please contact RXNT immediately.

As defined under the California Consumer Privacy Act, RXNT does not knowingly “sell” the Personal Information of minors under 16 years old who are California residents.


CALIFORNIA PRIVACY RIGHTS

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Websites that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. RXNT may update and otherwise revise this Policy at any time and for any reason. We encourage you to periodically review this page for the latest information on our privacy practices. We may provide additional notice to you if we make any changes that materially affect your privacy rights. Your use of our Websites, including the continued storage of your information on RXNT systems, following any such change, constitutes your agreement that all information collected from or about you through our Websites will be subject to the terms of the revised Policy.
